Thank you for using PhotoMill. All files have been compressed using DropStuff™. Expand the PhotoMill files by double clicking on the archive and selecting a location for the files. Documentation is provided in PDF format. If you do not have a copy of Adobe's Acrobat™ Reader application for viewing PDF files, you may download a copy free of charge from their Web site (http://www.adobe.com). Two copies of the manual are included. The "imposed" copy has been formatted to allow you to print, fold, and staple the manual in a booklet.

  14. Dolphin-Safe Software doing business as ("dba") Pacific Coast Software
  15. ("PCS") grants you a personal, non-transferable, non-exclusive license to
  16. use this copy of the software program and the accompanying documentation
  17. ("Software") according to the following terms and conditions:

  19. 1. License and Restrictions
  20. (a) This agreement grants you the right ("License") of use of one copy of
  21. the enclosed PCS Software on any single computer at any time. You may not
  22. copy or load the Software onto the same or additional computers or use the
  23. Software on a network unless you have purchased additional licenses for
  24. each instance of use.
  25. (b) The Software is owned by PCS and is protected by U.S. copyright laws
  26. and international treaty provisions. You must treat the Software just like
  27. a book or other copyrighted item, except that you may (i) make one copy of
  28. the Software program for backup or archival purposes, and (ii) transfer the
  29. Software program onto a single computer's hard disk or solid state storage.
  30. You may not copy any Software documentation provided to you.
  31. (c) This Agreement is your proof of License to exercise the rights granted
  32. herein, and must be retained by you. You may not lease or rent the
  33. Software, but you may transfer your rights under this Agreement on a
  34. permanent basis, provided that you transfer the Software, accompanying
  35. documentation, as well as this Agreement, and that the recipient agrees to
  36. the terms of this Agreement. You may not modify, merge, decompile or
  37. reverse-engineer the Software, and you may not remove or obscure the PCS
  38. trademark or copyright notices in the Software or documentation.
  39. (d) If you are an agency, department or other entity of the United States
  40. government, you shall be subject to restrictions of Restricted Rights for
  41. computer software developed at private expense as set forth in FAR
  42. 52.227-14, FAR 52.227-19 and DOD FAR Supplement 252227-7013(c)(1)(ii),
  43. including Alternate III and successors thereof, as applicable.
  44. 2. Title
  45. You acknowledge and agree that all right, title and interest in and to the
  46. Software, and all intellectual property rights therein, shall remain the
  47. property of PCS. You have a license to use the Software only and no
  48. ownership or proprietary rights to the Software are transferred to you.
  49. 3. Software Limited Liability and Disclaimer
  50. PCS MAKES AND YOU RECEIVE NO WARRANTIES OR CONDITIONS IN CONNECTION WITH
  51. THE SOFTWARE, EXPRESS, IMPLIED, STATUTORY OR IN ANY OTHER PROVISION OF THE
  52. LICENSE OR COMMUNICATION BETWEEN YOU AND PCS. PCS SPECIFICALLY DISCLAIMS
  53. ANY IMPLIED WARRANTIES OF NONINFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A
  54. PARTICULAR PURPOSE. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED
  55. WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
  56. 4. Limitation of Liability
  57. PCS'S LIABILITY UNDER OR ARISING OUT OF THIS LICENSE WITH RESPECT TO THE
  58. SOFTWARE, WHETHER FOR BREACH OF CONTRACT OR TORT OR OTHERWISE, SHALL NOT
  59. EXCEED THE AMOUNT THAT YOU PAID FOR THE SOFTWARE. IN NO EVENT WILL PCS BE
  60. LIABLE FOR ANY DAMAGES FOR LOSS OF DATA, LOST PROFITS, COST OF COVER OR
  61. OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING FROM
  62. THE USE OF THE SOFTWARE OR ACCOMPANYING DOCUMENTATION, HOWEVER CAUSED AND
  63. ON ANY THEORY OF LIABILITY. THIS LIMITATION WILL APPLY EVEN IF PCS OR AN
  64. AUTHORIZED DISTRIBUTOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE,
  65. AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY,
  66. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR
  67. INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY
  68. TO YOU.
